Terms and conditions
These terms cover using the TuMicha website, TuMicha Go, Driver, and
related payments. They include our refund policy,
cancellation policy, and
delivery policy, plus the other rules for accounts,
acceptable use, and the software. They are written in plain language.
They are not legal advice.

1. Who these terms cover
TuMicha is a South African software company. TuMicha Go is the
consumer network for rides, parcel deliveries, local shopping, Cloud
Print, and related apps. By creating an account, paying, or using
the site, you accept these terms.
-
You
A personal customer, a business, or a driver using TuMicha or
TuMicha Go, including people you invite to an account.
-
Independent sellers
Shops and service businesses on TuMicha Go sell their own goods
and services. TuMicha is the platform and, where you pay a
TuMicha delivery fee, the delivery network — not the seller of
those goods, except for TuMicha’s own products (for example
Cloud Print and app subscriptions).
-
In-product business terms
A verified business may have extra terms inside the signed-in
product. Those are not published here and are not part of this
page.
-
Related public pages
The software license is the
end-user license agreement.
Privacy is explained in the
Privacy Policy.
2. Accounts
You need an account for most paid features. Give true, current
details. Keep your login, devices, and any keys you are given
secure.
-
Personal, business, and driver
The same person may hold a personal account, a business
account, and a driver account. The email and phone on those
accounts must belong to the same person. You cannot mix
mismatched contact details across those surfaces.
-
One persona
Opening more than one of those accounts does not create a
partnership or employment relationship with TuMicha or with
other users.
-
Your responsibility
You are responsible for activity on your account, including
people you invite. Unauthorised use that happens because you
failed to take reasonable care is your risk.
-
Closing
You may close an account as the product allows, after settling
amounts due and finishing or cancelling open jobs.
3. Age and youth accounts
Personal accounts need a date of birth. We do not open personal
accounts for anyone under 13.
-
Ages 13 to 17
A youth account has limited permissions. Ads, trips, and paid
checkout stay off until an adult parent or guardian enables
them.
-
Parent or guardian
A youth account may link an 18+ parent or guardian. That adult
can turn ads on or off. Trips and checkout still need approval
for each action.
-
Adults
From 18, the personal account has the ordinary permissions the
product offers.
4. Using the software
We give you a limited, non-exclusive, non-transferable, revocable
license to use TuMicha websites and apps for your own personal or
business use, as the product allows. The full software license is
the end-user license agreement.
-
You may
Sign in, run your account, and use the features we offer, as
long as you follow these terms and the law.
-
You may not
Copy, sell, or rent the software; reverse-engineer it except
where the law allows; share login details; or use the platform
to break the law or abuse other people.
-
Ownership
TuMicha and its licensors own the software, brands, and design.
You keep ownership of the data you put into your account.
5. Acceptable use
Use TuMicha lawfully and fairly. We may remove content, limit
features, or close an account that breaks these rules or the law.
-
Not allowed
Fraud, payment abuse, identity theft, or using the platform for
money laundering or other financial crime. Illegal goods or
services. Hate, harassment, or threats. Scams, fake shops, or
prices and reviews you know are false. Exploiting children.
Circumventing safety or another person’s account. Malware or
unauthorised access. Spam.
-
People on the network
Treat drivers, shoppers, businesses, and TuMicha staff with
respect. Abuse can lead to a lost account.
-
Fair process
We try to give a chance to respond before a serious restriction,
except where delay would create a real risk of harm, fraud, or
unlawful activity.
6. Content and listings
You are responsible for listings, ads, messages, and other content
you publish. Shoppers may report harmful, illegal, spam,
misleading, or harassing content.
-
What we may do
We may pause or remove content that breaks these terms or the
law, and we may restrict an account that repeats the problem.
-
Your customers
If you collect customer or staff information for your own
business, you must have a lawful reason and meet your own
privacy duties. How TuMicha uses account data is in the
Privacy Policy.
7. Delivery policy
TuMicha Go delivers people, parcels, and shop orders through nearby
drivers in South Africa. Delivery is on demand: a job starts when
you pay the quoted amount and a driver accepts. We do not run a
scheduled courier with a guaranteed calendar day.
-
Where we deliver
South Africa, in areas where a driver or a participating
business is available. If nobody nearby can take the job, you
can cancel and we refund you as set out below.
-
Rides and parcel deliveries
You set pickup and drop-off, then confirm the live fare before
you pay. The fare is distance-based (a base amount plus a
per-kilometre amount). Busy areas may add a surge. The quote on
screen is the amount charged.
-
Shop orders delivered to you
The selling business prepares the goods. A driver collects them
and takes them to the address you pin at checkout. The delivery
fee is also distance-based and is shown on the checkout total
before you pay. Delivery fees are quoted in ZAR and are not
subject to VAT.
-
Collect in store
You may choose collection instead of delivery where the
business offers it. There is no delivery fee. If you already
paid a delivery fee and switch to collect while we are still
looking for a driver, we refund that delivery fee.
-
How long delivery takes
Once a driver accepts, the trip is live and you can track it in
the app. Time depends on distance, traffic, and how long the
seller needs to prepare an order. This is same-area, on-demand
delivery — not a multi-day shipping service.
-
Cloud Print
Print jobs are not couriered to your door. You pay, then collect
at a TuMicha print location with your release code.
-
Failed or incomplete delivery
If a paid ride or delivery cannot start because no driver
accepts, cancel it from Activity or Orders for a refund. If a
driver is already assigned, use in-product support so we can
look at that trip.
8. Cancellation policy
You can cancel before a driver is assigned or before a collect order
is ready. Once a driver is on the job, or a print has started, the
product will not let you cancel in the app.
-
Before you pay
Leave checkout or abandon a PayFast (or other card) redirect.
No payment is taken. An unpaid order or trip can also be
cancelled from Activity or Orders.
-
Paid rides and parcel deliveries
Cancel from Activity while the job is still waiting for a
driver. We refund the fare. After a driver accepts, you cannot
cancel in the app.
-
Paid shop orders
The buyer may cancel while the order is waiting for the
business or still searching for a driver. You cannot cancel
after a driver is assigned. Collect orders can be cancelled
while they are still being prepared, not after they are marked
ready. The selling business cannot cancel a paid order.
-
Switching to collect
While we are still looking for a driver, you may switch a paid
delivery order to collect in store. That cancels the delivery
job and refunds the delivery-fee portion.
-
Cloud Print
Cancel a print job before it starts sending or printing.
Printed jobs cannot be cancelled.
-
App subscriptions
Cancel a paid app from the App Store in the product. Access
continues until the end of the period you already paid.
Cancellation does not cut the period short.
-
Cooling-off (where the law applies)
For some electronic transactions, the Electronic Communications
and Transactions Act 25 of 2002 gives a seven-day cooling-off
right to cancel unused goods that have not yet been supplied.
That right does not usually apply once a ride or delivery
service has started, to perishable or custom goods, or to other
exceptions in that Act. Consumer Protection Act rights that
cannot be excluded stay in place.
9. Refund policy
Eligible refunds go back to the same card or payment method you
used. We start the refund when the cancellation or refund request
is accepted. Your bank or card issuer typically shows it in
5 to 10 business days.
-
When TuMicha refunds in full
A paid ride, parcel delivery, or shop order that you cancel
under the cancellation policy above; or a paid trip that never
starts because no driver is available.
-
When we refund only the delivery fee
You switch a paid shop order to collect in store while we are
still looking for a driver. The goods total stays paid; the
delivery fee is refunded.
-
Shop goods after handover
Once goods are collected or delivered, returns and refunds for
those goods follow the selling business’s refunds policy
(a till location must publish one before it takes card
payments). Contact that business first. TuMicha can still
refund a TuMicha delivery fee where this policy says we will.
-
Cloud Print
A job cancelled before it starts sending or printing is
refunded to the original payment method. Printed pages are not
refunded, except where the law requires it.
-
Subscriptions
Unused time in a paid app period is not refunded when you
cancel at period end, except where South African consumer law
requires a refund.
-
How to ask
Use cancel in Activity or Orders where the app allows it. For
anything the app cannot cancel, email
owner@tumicha.co.za
or use in-product support. Include your order or trip
reference.
-
Failed refunds
If the card issuer declines a refund, we retry or complete it
another way and may email you. Do not raise a duplicate refund
for the same payment.
10. Returns
Physical goods are sold by independent businesses on TuMicha Go, not
by TuMicha (except TuMicha’s own products).
-
Unused goods
Return them to the seller as that business’s refunds policy
allows. Arrange collection or a new delivery with the seller.
Keep the goods unused and in a resaleable condition unless the
seller or the law says otherwise.
-
Wrong, damaged, or missing items
Contact the selling business first. If the problem is the
TuMicha delivery itself, contact us with the order reference.
-
Completed rides
A ride or parcel trip that has already been carried out is a
consumed service and is not returned, except where the law
requires it.
11. Payments
-
Currency
All prices and charges are in South African Rand (ZAR).
-
How you pay
Card checkout may use PayFast or another payment partner we
enable. Shop and trip checkout are card-only. Cash on delivery
is not offered.
-
When you are charged
You pay the quoted total before a driver is assigned or a shop
order is sent to the business. The payment partner confirms the
charge; then the job or order opens.
-
Wallets and payouts
Wallet balances and payouts depend on the product, payment
partners, and the law. TuMicha is not your bank. Timing can
vary.
-
Chargebacks
Ask us for a refund first where this policy allows one. If a
chargeback or payment-partner penalty is caused by your
conduct, you remain responsible for that amount.
12. Subscriptions
Some apps are included with an account. Others are paid. Prices and
what an app does are shown in the product before you subscribe and
may change on notice.
-
Billing
Paid apps renew for the period shown at checkout unless you
cancel. Cancel at period end from the product.
-
Queries
You may query a bill through in-product support or
owner@tumicha.co.za.
13. Drivers
Drivers are independent. Signing up does not make you a TuMicha
employee, and it does not make a shopper or business your employer.
-
Work
You choose when you are online. We may offer nearby jobs while
you are online. You must hold any licence and insurance the law
requires for the vehicle you use.
-
Pay
Earnings come from the fare or delivery fee on jobs you
complete, as the driver product shows. Payout timing follows
the driver wallet and payment partners.
-
Privacy
Location is used while you are online so we can offer nearby
jobs. Details are in the
driver privacy policy.
14. Businesses
A business account is a workspace on the platform. It does not, by
itself, make you a live merchant. Extra terms that apply only after
a business is verified live inside the product and are not on this
page.
-
Your shop
You are responsible for your catalogue, prices, stock,
bookings, fulfilment, tax invoices, and your consumer-law
duties to your own customers.
-
Team
Actions by people you invite are treated as yours.
-
Independent
You are not TuMicha’s partner, agent, or employee because you
opened an account. Drivers and shoppers are not your employees
because of these terms.
15. Connected software
You may connect a third-party product we offer (for example
accounting software). Those products have their own terms. You can
disconnect in the product at any time. See the
end-user license for the software
licence around those connections.
16. Availability and responsibility
We run the platform with reasonable skill and care. We do not
promise uninterrupted service. The service may be unavailable
during maintenance, outages, or events outside reasonable control
(including network, power, or payment-partner failures).
-
What we still stand behind
We remain responsible for our own fraud, wilful misconduct, and
gross negligence, and for death or personal injury caused by
our negligence. We do not exclude any liability the law does
not allow us to limit.
-
What we are not
We are not the seller of an independent business’s goods or
services, and we are not your lawyer, bank, insurer, or tax
agent.
-
Your rights stay
Nothing here asks you to waive rights under the Constitution,
the Consumer Protection Act, or POPIA that the law does not
allow to be waived.
17. Changes and closing
-
Updates
We may update these terms. The effective date at the top is
the current version. If you do not agree to a material change,
stop using the service and close the account as the product
allows.
-
We may limit or close
We may suspend or close an account for breach, unpaid fees,
fraud risk, illegal activity, abuse, or a legal demand, and we
may keep records the law requires.
-
If a clause fails
If a court finds one part unenforceable, the rest stays in
force.
18. Law and contact
These terms are governed by the law of the Republic of South Africa.
Try to resolve a dispute first through in-product support or the
email below. If that fails, either side may use the South African
courts that have jurisdiction, or another forum the law requires.
Either side may still seek urgent court relief.
